There are many times when you can quite properly ask you employer for time off work, either because they’re laid down by law or they’re in your contract, for some of these the law says you will be paid and for others you can have the time off but you won’t be paid. Some of these times will seem odd but you will notice there are some things missing like hospital appointments or the dentist.

Everything on these pages is the minimum that everybody is entitled to by law your contract can give you better than this BUT cannot give you less.

Holidays

If you work full time you’re entitled to a minimum of 20 days paid holiday per year these 20 days include bank holidays. The government is considering changing this so you will get 20 days plus the bank holidays but nothing has happened to change the law yet. If you work part time then you will get holidays in proportion to the amount of time you work. Don’t forget your contract might give you better holidays than the minimum. Jury service

It is possible that at sometime in your working life you will be called on to serve on a jury and if you don’t turn up to serve on the due date you could be fined or imprisoned for contempt of court. Even though the law requires you to serve on the jury your employer does not have to give you the time. If your employer says that they will not allow you to have the time off to serve you should contact the court asap and talk to the “summoning officer” using the section on the summoning form. If the firm allow you to serve they do not have to pay you but you can claim for loss of earnings from the court. For more information about jury service go here.

Attending court as a witness

Again you have no right to time off but if summonsed or subpoenaed you can be held in contempt of court if you do not attend. You will need to negotiate with your employer to get the time off. Again you have no right to pay.

Public duties

What are public duties?

Public duties are where you have been elected to or appointed to serve as, justice of the peace, local councillor or a school governor. There are many others but these are the main three. You have no right to be paid for attending meetings of these bodies but many of them will compensate you for loss of earnings. Some memberships of public bodies are actually paid positions.

Study or training

If you’re between 16 and17, or 18 if you are finishing a course, and studying while working then you are entitled to reasonable time off with pay. You don’t need to have worked for employer for any particular length of time.

Trade Union Activities

If you’re a Shop Steward or other Trade Union Official, Health and Safety Representative then you are entitled to reasonable time off with pay. As an ordinary member you are entitled to attend meetings and carry out other union activities at an appropriate time. This could be during working time, with the permission of the employer but not with pay.

If your work is making people redundant then you will have rights to time off with pay to look for another job. There are limits to the amount of pay you can get and you must have worked for the employer for two years before you will have this right.
